the labor department says the number of people seeking unemployment benefits dropped by 5,000 last week, the fourth decline in five weeks. stocks were up, the dow gained 84.5. the s&p 500 picked up 12. nasdaq added 38. the gasoline prices held but were up slightly. the april crude fell 15 cents to settle after $105.60 a barrel. there is a question tonight about why the u.s. government is guaranteeing billions of dollars of loans to develop

would be, "a grand bargain that rearranges the entire financial order." >> we're moments away from secretary of state clinton statement on the future of libya and that agreement that was reached with nato late this afternoon. while we wait for that, go to steve steve harrigan on the ground in tripoli. steve? >> as we bait for that news, we're nearing more attack here in the capital of tripoli. we have small arms fire in background. earlier this evening. for the sixth night in a row we heard heavy incoming fire. they sounded like two cruise missile strikes as well as outgoing antiaircraft fire. the antiaircraft fire is not guided by radar. it's basically big guns on the back of pickup trucks so very little threat to coalition air jets in the area. as far as the fighting on the ground goes, there is really a key test for the rebels around the city of ajdabiyah.

that could be a site of their first victory. right now, they are gathering outside of that city. gaddafi forces still inside. the gaddafi forces have been weakened by the coalition airstrike against the tank and mechanizeed vehicle. the rebels are unorganized and lightly armed often with the rocket-propelled grenades or machine guns but numbers grow in part due to no fear of attack from the gaddafi air force which now no longer can operate in the skies. back to you. >> steve, i take it rebels are encouraged by all the information support they've gotten. cothey think this is a fight they can win now? >> we see them make a charge and then retreat. organized force and it's growing they've been heartened by the coalition support. solidify the base in benghazi and they have a test and real fight to come.

changing face of the united states population. molly henneberg takes a closer look at the numbers and the political implications. >> the headlines release today show the number and the overall footprint of hispanic population growing. >> people of hispanic origin represent the second largest group in the country. with 16% of the total u.s. population. >> officials say the census does not differentiate between legal and illegal residents. non-hispanic whites are the majority. 64% of the population. but that is down from 69% ten years ago. blacks are still the third largest group. 12.2% from 12.1% a decade ago. what could the increase in hispanics mean politically? an am list says while the blacks tend to vote for democrats, it's more split on

first, we have jennifer griffin at the pentagon and steve harrigan in tripoli standing by. jennifer, first, let me ask you. what do we know about the nato agreement? >> it's a partial agreement and that is one of the reasons that secretary of state clinton may be running late. they agreed to part of this mission. they are going to enforce the no-fly zone. they agreed to that but there are ongoing discussions that need to take place in order for them to agree all 28 members to take on commander and control of the entire mission. the entire mission under the u.n. security council 1973 which would include protecting civilians. so they basically have parsed this. so that they have agreement about enforcing the no-fly zone. that will follow under nato. but there are ongoing discussions and concern from turkey and wrangling going on behind the scenes about whether they will hand the entire commander and control over to nato. jim? >> as we understood it, even though the u.s. was trying to

get nato to take over control of this thing, the u.s. planes were going to continue to fly and enforce the no fly zone, right? >> they will. they be under the supreme allied commander, under nato. there is an american who is in charge of nato. and so, they will be flying under an american commander. the question is will general carter ham be able to hand off responsibility for the rest of the mission. which is what we're seeing in terms of protecting civilians going after gaddafi forces. one problems that you have is you have arab league members and muslim country part of nato, turkey, which are concerned about what the definition of the mission is. they don't want their planes dropping bombs on muslims or another arab state. >> go to steve on this. there were reports that

coalition partners were in tough with the rebels if not to coordinate with them to have a complete coordination to avoid the problem that jennifer was just talking about. >> that is the debate, how much of a coalition there will be between forces on the ground. helping them or targeting them or giving them escort to battle. by targeting the mechanized vehicles. paving the way. are they allies in the war together. the question in the nato alliance, too. a difference of opinion how big the role should be. while we expect detailed command structure and organization with history of carrying out the conflict, there is tension within the alliance as well. how big the tension will be.

>> steve, do rebel groups have enough communication to know how much of the world is involved in the operation? and the debate that is going on over their fate? >> that rebel group is evolving and changing as we speak. getting really on the fly training right now from some of defective gaddafi fighters that joined their ranks. even numbers changed dramatically. keep in mind, ten days ago, this was practically a defeated force. numbers in the field had gone from thousands to just hundreds. and they were really on a ten-day retreat all the way back to benghazi. they were practically rescued at the 11th hour by french fighter jets. now they're beginning to rebuild again. they are again filled with confidence. but, remember, ten days ago we saw them on the run. now they are approaching what could be a key battle in one of the cities here. how much help will they get from the forces that have

column of the gaddafi forces in the past? if you have gaddafi forces inside the city, there are concern about the casualty and the collateral damage. how will they stand up against the better train and equipped forces when they battle for the cities? jim? >> jennifer, back to you if i may. a libyan pilot tried to challenge the no-fly zone in the last 24 hours and was shot down by a french mirage jet. what do people think of that? >> first of all, a training jet. it was not a war plane per se. it's not clear whether it had taken off the french destroyed it on the ground, the french officials say it had taken off and landed when they were struck.

you are on to something because this agreement isn't worth much to nato, because there are no planes flying around that are libyan. libya only had a few dozen planes to begin with and they have not posed a threat to civilian population. what nato has not agreed on is what the command and control structure of thelition force that is headed by general carter ham, whether it will fall under their command and if they're authorized to stop gaddafi forces according to the u.n. security council resolution 1973. this is a partial agreement at best out of faye toe. >> if i remember correctly, the u.n. resolution said using all necessary means. that would suggest that someone could act to keep gaddafi forces from slaughtering the millions. do you have a sense that the u.s. might do it on its own outside the nato agreement? >> i believe what we will see

happen is the u.s. will still be in charge of that part of the operation until nato agrees to take over that part of the operation. you see nato has it in two parts. enforcing the fly zone and what they have not agreed to take on yet the rest of the mission, to include flying missions that are currently flown. that is what they want them to take responsibility for. >> so if we saw gaddafi forces headed for rebel areas, with tanks and soldiers about so forth, is it your sense that the u.s. would do something to stop them before they arrive? >> yes. nato has said they will take over command for enforcing the no fly zone.

they divided up u.n. security council resolution to two parts and they are not taking command from general carter. a u.s. general, still in charge of the operation. you have the french fighter jet and danish fighter jet willing to support the rest of the security council resolution. >> let me go back to steve. how much close contact is there between the rebel groups and government forces, between gaddafi's forces? is it mostly distant fighting at this point? or do you have people doing hand-to-hand confrontations? >> there is close fighting street to street. it certainly is when you have the gaddafi forces sometimes leading the tank and they know are targets to get in civilian

cars. trying to tell who is who and on which side gets complicated in the battle. there are two key cities they shape up. one is the fourth largest city and the other is ajdabiyah. they are still untested. we see if they get attention they're blustered right now. they haven't won a battle yet against the entrenched forces. >> we're still waiting for secretary of state hillary clinton to talk about the agreement or the lack thereof. a full agreement with nato or the future of operation in libya by the coalition. threatened to come out at

6:15. she has not come out yet. as you can see here. we are waiting for her. take her live when it comes. bring in the panel now. jonah goldberg, from national review online. quisten powers, from "new york post." and syndicated columnist charles krauthammer. the secretary is coming out to announce the agreement. but it doesn't sound like the agreement has yet been set. >> sounds like there is no agreement on what counts. the no fly zone is meaningless. one guy gave at it shot. he lasted a couple of minutes. the important mission is who this in control of airstrikes to keep the rebels alive? they are attacking the tank and artillery that gaddafi deployed. that nato has not agreed to

take over. the reason appears to be that the turks who are extremely resistant to the entire operation have been the one insisting on extremely strict rules of engagement. which i expect other allies think would be difficult to carry out and live with. and still be effective. that's why it's hung up. what is remarkable is unnecessary wranglal and debate and agreement. the u.s. was in charge. the president decided we shouldn't be and we have a stalemate over the nato taking over. the fact turks resist it. >> we're waiting for secretary of state clinton to come out and talk. we talk to the rest of the panel after this break. stay with us. so i need the entire team together on this

this is a fox news alert. we're waiting for secretary of state hillary clinton to come out and talk about libya, future of the u.s. role and agreement they are working on with nato. that agreement was supposed to have been finish and the secretary was expected at 6:15 but apparently a last-minute snag. so she has not yet emerged to tell us what the deal is. in the meantime, we have a panel here. charles had his shot before we went to the break. now we go to kirsten and jonah. what do we make of this. >> charles, being critical of obama for not wanting the u.s. to stay in the lead. that's medicated on the idea that we could be there in the first place. obama said we'd be there days, not weeks. we're at six days. what we are doing is coming in under the clock, saying we're

handing it off to nato. the reality we all know we're still doing everything. nobody else has the capabilities that the united states has. this is just a little bit of a game that they're playing. we need more than a no fly zone. in a situation. if you think we should be there. >> why is this important at all? >> i don't think is important. barack obama imagined to alienate everybody from hippies to bomb before breakfast neokahn. i was in favor of -- [ inaudible ] i think that obama waited three weeks. and really missed the real opportunity. but this idea that the fiction, somehow we're handing it to nato, an organization we're the supreme commander of. it's like scene at the end of spartacus. no, i'm spartacus.

but everybody knows who it is. it doesn't matter. >> let me go back to jennifer griffin at the pentagon. are you getting more word on what is holding up the final agreement? >> i think what is holding up the secretary of state hillary clinton coming out and speaking to us, because she was supposed to announce this at 6:15, they are trying to interpret what is essentially a non-agreement. by nato. nato parsed this in a way they agreed to a no-fly zone but we said there are very few libyan planes that are capable of flying at this point. that was not the point. the reason that nato is continuing the discussion taking over the command for the entire operation is that certain members, the turks being in the lead have, coming to this coalition with tav yachts. we knew that the qataris when

they sent four warplanes. we haven't heard are they going to drop bombs? we know that the united arab emirates had concerned and from the begin they were only going to fly humanitarian commission, not drop bombs. there is a third arab state considering sending warplanes but the caveat is they won't drop the bombs. so they have caveat and they are trying to work it together. they are trying to determine what they can say about the so-called partial agreement out of nato tonight. >> so charles, what do you think is going on behind closed doors? >> working on lang wang that it will disguise a failure. thesaurus of language to take care of that. this is not meaningless. we have command and control of the of ration. tremendous success on the ground. obama is the one two decided he wanted in.

now he wants out of command and control. makes a decision that america is in. but if he relinquishs command and control it's on nato, that operates on the consensus. all 28 countries have to agree on targeting. all of the details in the hands of an american commander who can make a rational decision unified command will be in the hands of a committee of 28, including the turks who don't want to be in the operation in the first place. that is why it's important and absurd. >> does it matter if the muslim nation drop bombs? >> this matters if you have the position that the united states is not replacing the world. we don't need to get involved in every problem in the world.

i think there is very little evidence to support and if it was true, and if we saw the hundreds thousand people rounded up who are about to be massacred we'd talk about the different situation. that's not what is happening here. the other thing here is who are the rebels? we have people talk about arming the people. every expert i read said they're incapable of overthrowing gaddafi. what are we doing there? what is the end game. this is something that secretary clinton should talk about since the president isn't telling us. what is the end game here? >> i want to play something from the director of the joint staff who described the u.s. role and the role of the coalition this way. >> when and where the regime forces threaten lives of their own citizens they'll be attacked. when and where they fire

combat aircraft or fire at coalition aircraft, they'll be attacked. when and where they attempt to break the embargo, they will be stopped. our message to the regime troop is simple. stop fighting, stop killing your own people or obey orders of colonel gaddafi. >> threaten their citizens, they will be attacked. steve harrigan on the ground in tripoli. steve, have you seen any evidence that what vice admiral gordon is talking about has occurred on the ground? >> we have possible cease-fires several announced in tripoli but they haven't helped. this is where the gaddafi forces are inside the city. it will make it difficult in cities like ajdabiyah and masarata to get them out of there, especially if you use air power. they are uncapable in a
